The rules we buy and sell under.
Plain terms for buying from StackMart, whether you are a retail customer or on a trade account. Nothing here reduces your rights under the Australian Consumer Law.

1. Who you are dealing with
These terms are between you and StackMart, ABN 83 702 019 896, an Australian IT and AV distributor operating from Melbourne. You can reach us on 03 9124 4699 or at sales@stackmart.com.au.
By placing an order you accept these terms. We may change them at any time; the version on this page when you order is the one that applies to that order.
2. Prices
- All prices are in Australian dollars and include GST unless the page you are looking at says otherwise. Trade accounts can switch the display between ex GST and inc GST.
- Prices move with our suppliers and can change without notice. The price that applies is the one shown when your order is placed.
- Freight is calculated at checkout before you pay. See Shipping & delivery.
3. Pricing and description errors
We carry many thousands of lines, and the price, specification and image on a product page come in large part from our suppliers. Errors happen.
Where a product is listed at an obviously incorrect price, or its description is materially wrong, we may cancel the order and refund you in full rather than supply it. We will tell you before doing so and you may reorder at the corrected price. This does not affect your rights where goods you have received are not as described.
4. Orders and acceptance
Your order is an offer to buy. A contract is formed when we confirm the order as accepted or dispatch the goods, whichever happens first — not when the website sends an automated order-received email.
We may decline or cancel an order, refunding you in full, where the goods are unavailable, where there is a pricing or description error, where we cannot verify your details, or where we reasonably suspect fraud.
5. Stock availability
Stock figures on the site come from our distribution partners and are updated frequently, but they are not a reservation. Stock can sell out between your order being placed and being picked.
If something you ordered is unavailable we will contact you and offer a backorder, an alternative, or a refund of that line. We do not substitute products without asking you first.
6. Payment
- Payment is due in full before goods are dispatched, unless you hold an approved trade account with agreed terms.
- Trade accounts are subject to approval, credit limits and the payment terms set out in your account approval. We may suspend an account that is outside its terms.
- Purchase order references are printed on your invoice where you supply one.
7. Title and risk
Title in the goods stays with StackMart until we have received payment in full. Risk passes to you on delivery, or on collection if you choose local pickup.
Until title passes you must keep the goods identifiable and insured, and we may recover them if payment is not made.
8. Delivery and collection
Dispatch times, freight charges, delivery estimates and pickup locations are set out on the Shipping & delivery page and form part of these terms.
Delivery estimates are carrier estimates, not guarantees, and we are not liable for delays caused by a carrier or by events outside our control. Someone must be available to receive the goods; we cannot deliver to a PO Box.
Tell us within 2 business days if a delivery arrives damaged or short. Claims raised after that window cannot be lodged with the carrier.
9. Returns, warranty and your consumer rights
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms limits those rights.
Change-of-mind returns, faulty goods, RMA numbers and manufacturer warranty periods are covered on the Returns & warranty page, which forms part of these terms.
10. Software, licences and subscriptions
Licence keys, activation codes and subscription services are supplied subject to the vendor’s own terms, and cannot be returned once redeemed or activated. Where a vendor requires you to accept its licence agreement, that agreement is between you and the vendor.
11. Liability
Subject to your rights under the Australian Consumer Law and to the guarantees that cannot be excluded, our liability for any claim relating to goods we supply is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing any of those things.
We are not liable for indirect or consequential loss, including loss of profit, loss of data, or loss arising from equipment being unavailable. Back up your data before sending any storage device to us.
12. Your obligations
- Give us accurate delivery and contact details. We are not responsible for goods delivered to an address you supplied incorrectly.
- Check that what you are ordering suits your purpose. We are happy to advise before you buy — that is what the phone number is for — but the final choice is yours.
- Keep your account credentials secure and tell us promptly if you think they have been compromised.
13. Privacy
How we handle your personal information is set out in our Privacy policy.
14. Governing law
These terms are governed by the laws of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state.
15. Quotes
Quotes are covered by our Quote terms. In summary: a quote holds its prices until the date shown on it, applies only to the items and quantities quoted, can be ordered once, and its shipping isn’t discounted.
Something here unclear?
Ask before you order rather than after. We would rather answer the question.
